Terms of Service

1. Acceptance

By creating an account or using Pear Show (the "Service"), operated by Pear Show ("we", "us"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. The Service

Pear Show provides live-selling tools, analytics, label printing, and related software for sellers on Whatnot, TikTok, Facebook, and similar platforms. Features and pricing may change over time.

3. Accounts

You are responsible for safeguarding your credentials and for all activity under your account. You must be at least 18 years old and able to enter into a binding contract.

4. Subscriptions, Trials & Billing

Pear Show is offered as a recurring subscription. Free trials, if offered, automatically convert to a paid subscription at the trial's end unless cancelled. Subscriptions renew automatically until cancelled. You authorize us and our payment processor (Stripe) to charge your payment method on each renewal.

Fees are non-refundable except where required by law. You may cancel at any time from your billing portal; cancellation takes effect at the end of the current billing period.

5. Acceptable Use

You agree not to: (a) use the Service to violate any law or third-party platform's terms; (b) reverse engineer or attempt to bypass technical limits; (c) resell or sublicense the Service; (d) upload unlawful, infringing, or harmful content; (e) use the Service to harass buyers or spam customers.

6. Third-Party Platforms

Pear Show interoperates with third-party platforms such as Whatnot, TikTok, and Facebook. We are not affiliated with, endorsed by, or responsible for those platforms. Your use of them is governed by their own terms.

7. Your Content & Data

You retain ownership of content and data you upload. You grant us a limited license to host, process, and display it solely to operate the Service for you. You are responsible for the legal basis for any buyer/fan data you collect.

8. Intellectual Property

The Service, including software, branding, and content authored by us, is owned by Pear Show and protected by intellectual property laws. We grant you a non-exclusive, non-transferable license to use the Service while your subscription is active.

9. Termination

We may suspend or terminate your account for violation of these Terms, non-payment, or risk to the Service. You may stop using the Service at any time.

10. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that AI-generated suggestions will produce specific results.

11. Limitation of Liability

To the maximum extent permitted by law, Pear Show's total liability for any claim is limited to the amount you paid us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

12. Changes

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the United States and the State of your billing address, without regard to conflict-of-law rules.
